Acceptable Use Policy

Stamply’s Acceptable Use Policy (referred to as this “Policy”) outlines the prohibited activities within the digital customer loyalty program services and other related services (collectively referred to as the “Service”) provided by Stamply.io – UK (“Stamply”), as well as the associated website found at https://stamply.io (referred to as the “Site”). This Policy is intended to complement and be integrated into Stamply’s Subscription Agreement (currently accessible at https://stamply.io/subscription-agreement) (the “Subscription Agreement”) and the Terms of Use for the Site (currently available at https://stamply.io/terms) (the “Terms of Use”). In the event of any conflict between a provision in this Policy and the Subscription Agreement or the Terms of Use, the applicable terms of the Subscription Agreement and the Terms of Use will take precedence unless this Policy explicitly states otherwise.

Should you breach this Policy, Stamply reserves the right to suspend or terminate your access to the Service or the Site. Stamply’s authority to suspend or terminate your use of the Service or Site extends to situations where breaches occur inadvertently or without your authorisation. This action may be deemed necessary by Stamply to ensure compliance with the law or to safeguard the rights, safety, privacy, security, or property of Stamply, its customers, or third parties.

Stamply retains the right to make alterations to this Policy at its discretion, with any updates being posted on the Site. By utilising the Service or accessing the Site, you agree to abide by the most recent version of this Policy.

**Intellectual Property**

The use of the Service or Site in a manner that results in the infringement, dilution, misappropriation, or violation of any intellectual property or proprietary rights of others, including but not limited to copyrights, patents, trademarks, and trade secrets, is strictly prohibited.

**Harmful Content**

You are prohibited from using the Service or Site to transmit, store, display, distribute, or otherwise make available content or technology that may harm, interfere with, secretly intercept, or expropriate any system, program, or data. This includes, but is not limited to, viruses, Trojan horses, bots, worms, scripting exploits, time bombs, or any other malicious code.

**No Framing or Scraping**

Without Stamply’s express prior written consent, you may not frame or mirror the Site. Additionally, you may not use any robot, spider, site search/retrieval application, or other manual or automatic device to retrieve, index, “scrape,” “data mine,” or collect any content from the Service or Site, or to reproduce or circumvent the navigational structure or presentation of the Service or Site, without Stamply’s express prior written consent. However, Stamply does grant permission to public search engines to use spiders for copying material from the Site solely for the purpose of creating publicly available searchable indices of such material, excluding caches or archives of such material. Stamply reserves the right to revoke these exceptions on a general or case-specific basis.

**Email and Unsolicited Messages**

The use of the Service or Site for transmitting unsolicited email or other messages, including, but not limited to, unsolicited bulk email (“spam”) or excessive email or messages intended to harass or annoy others, is strictly prohibited. It is also impermissible to continue sending emails or other messages to a recipient who has expressed a desire not to receive them. Altering or obscuring email or message headers or assuming a sender’s identity (including, but not limited to, “spoofing,” “phishing,” or similar attacks) without explicit permission from the sender is not allowed.

**System Security**

The Service or Site must not be used to violate the security or integrity of any network, computer, communications system, software application, or computing device (referred to as a “System”). Prohibited activities include, but are not limited to, attempting to: (a) probe, scan, or test the vulnerability of a System or breach security or authentication measures without authorisation; (b) make network connections to or access a System without authorisation; (c) monitor data or traffic on a System without authorisation; (d) tamper, reverse-engineer, hack, interfere with, disrupt, or disable a System, including, but not limited to, overloading, “flooding,” “mailbombing,” “crashing,” or engaging in denial of service attacks; (e) forge any TCP/IP packet header or any part of the header information in any e-mail or newsgroup posting; (f) use another party’s account name or persona without authorisation; or (g) take any action to obtain a Service to which you are not entitled.

**Privacy**

The Service or Site must not be used to infringe upon the privacy or confidentiality of others. This includes transmitting, storing, displaying, distributing, or otherwise making available the private or confidential information of others (including, but not limited to, their account names or personal data associated with their Service or Site account) without authorisation.

**Compliance with Laws**

In addition to the aforementioned prohibitions, the Service or Site must not be used for any illegal purposes or in violation of any laws, including, but not limited to, data, privacy, consumer protection, and export control laws.

**No High-Risk Use**

The Service must not be used in situations where a failure or fault in the Service could lead to death or serious bodily injury, or result in physical or environmental damage. For example, the Service may not be used in connection with aircraft or other modes of mass transportation, or nuclear or chemical facilities.

**Responsibility for End Users**

You are responsible for any violations of this Policy committed by individuals using the Service or Site with your authorisation or by using your account without authorisation. Assisting another person in an activity that would violate this Policy if performed by you is also considered a violation of this Policy. These rules apply to anyone accessing or using the Service or the Site. Each prohibition within this Policy applies to any action directly or indirectly taken, authorised, facilitated, promoted, encouraged, or permitted by a user of the Service or Site, even if such a person did not personally violate the prohibition.

**Monitoring and Enforcement**

Stamply has the right, though not the obligation, to investigate any violations of this Policy or misuse of the Service or Site. Stamply may, at its sole discretion, edit, refuse to post, or remove any material submitted to or posted on the Service or the Site if it is found to be in violation of this Policy. Additionally, Stamply may report any activity suspected of violating any law or regulation to appropriate law enforcement authorities, regulators, or other relevant third parties. Such reporting may involve disclosing customer data when appropriate. Stamply may also cooperate with law enforcement agencies, regulators, or other relevant third parties to aid in the investigation and prosecution of illegal conduct by providing network and systems information related to alleged violations of this Policy.

**Reporting Violations**

Should you become aware of any violation of this Policy, it is imperative that you immediately notify Stamply by email at [email protected]. You must also be prepared to provide Stamply with assistance, as requested, to halt or rectify the violation.
